Refund and Cancellation Policy

Digistick (the “Company”) maintains a strict Refund and Cancellation Policy to protect its business interests and clarify the terms under which refunds or cancellations may be granted. By engaging Digistick’s services, the Client acknowledges and agrees to the terms of this Policy. The following sections outline Digistick’s position on refunds, cancellations, and related legal liability in clear, unequivocal language.

Refund Policy

Digistick enforces a no-refund policy except in the limited situations expressly described below. In all cases, Digistick’s determination of fault and entitlement to any refund is final. Unless otherwise agreed in writing by Digistick, no fees are refundable once paid. The key terms of our Refund Policy are:

  • Non-Refundable Services: All fees for creative and production-based services—such as User-Generated Content (UGC) creation, photography/videography shoots, video editing, graphic design, content creation, and similar projects—are expressly non-refundable. Once Digistick has commenced any portion of the work or allocated any internal resources to the Client’s project, the Client irrevocably waives any right to a refund for those services.

  • Client-Initiated Changes or Cancellations: Under no circumstances will Digistick issue a refund if the Client changes their mind, postpones, or cancels the project for any reason. This includes, but is not limited to, cancellations due to personal emergencies, health issues, change of requirements, death, or any other personal circumstances. The Client bears full responsibility for any decision to delay or cancel services and forfeits any fees paid as a result.

  • Limited Refund Exception (Company Fault Only): The only scenario in which a refund may be granted is when Digistick is solely responsible for failing to deliver the contracted services. For example, a refund may be considered if Digistick fails to begin work within the agreed timeline or if the Digistick team is grossly non-responsive to the Client’s requests. Even in these cases, Digistick will only issue a refund at its sole discretion, after deducting all applicable taxes, government fees (including GST), and any third-party charges incurred on behalf of the Client. Any approved refund will be processed in the manner described in the Refund Request Process section below.

  • Work Commencement and Resource Allocation: For the avoidance of doubt, Digistick deems all funds to be earned and non-refundable once work has commenced. As soon as Digistick allocates personnel, equipment, or other resources to the Client’s project (including any preparatory work, development, or creative efforts), the Client is not entitled to any refund. All payments become non-refundable upon the initiation of services.

Digistick’s Refund Policy is designed to ensure clarity: all fees are non-refundable unless Digistick clearly breaches its obligations, as detailed above. This policy applies equally to all clients and projects, without exception.

Cancellation Policy

The following terms govern cancellation of services by either the Client or Digistick. These terms protect Digistick from liabilities arising from cancellations or delays.

  • Client Cancellations: If the Client cancels or postpones any service or project at any time for any reason, the Client is not entitled to any refund, credit, or compensation of any kind. The Client remains responsible for all fees and costs incurred up to the time of cancellation. No return or reduction of fees will be provided for client-initiated cancellations, regardless of the circumstances (including changes of mind, scheduling conflicts, personal emergencies, or any other cause). Digistick shall have no obligation to refund or credit any portion of the fees paid by the Client.

  • Digistick Cancellations: In the unlikely event that Digistick must cancel or terminate the engagement before or during the provision of services (for reasons attributable to Digistick), the Company may, at its sole discretion, refund a portion of the fees. Any such refund will be handled according to the terms of the Refund Policy above, and will be reduced by the total of any government taxes, statutory fees, or third-party costs. Digistick’s obligation in this scenario is strictly limited to the refund mechanism described and does not extend to any additional compensation.

  • No Rescheduling or Partial Refunds: Digistick is not required to accommodate client requests to reschedule or modify a booked service. Any rescheduling or changes are subject to Digistick’s approval and may incur additional charges. However, no refund will be granted for time or resources already allocated under the original schedule. If a project is canceled by the Client before Digistick begins any work, Digistick may consider issuing a partial refund after deducting any non-recoverable costs, but only if the Client’s request complies with the Refund Policy. This is entirely at Digistick’s discretion.

  • Client Responsibility and Payment: The Client is responsible for timely payment of all scheduled fees regardless of any cancellation. A written cancellation notice may be requested by Digistick, but providing such notice does not, in itself, entitle the Client to a refund. The Client acknowledges that all obligations to pay fees arise from the original agreement and are not negated by cancellation.

Refund Request Process

All refund requests must strictly follow Digistick’s established procedure. Digistick will process only those requests that comply with the Policy and meet internal verification standards. The refund request process is as follows:

  1. Submission via Email: The Client must submit a written request by email to Digistick’s support address "support@digistick.in". The subject line should read “Refund Request – [Invoice/Project Reference].” The email must include the Client’s name, contact information, project reference or invoice number, and a detailed explanation of the reason for the refund request.

  2. Documentation: Along with the request, the Client must attach any relevant documentation, such as contracts, invoices, or correspondence, that support the claim. Failure to provide complete information or proof of purchase may result in denial of the refund request.

  3. Timing: Refund requests must be submitted promptly and in writing. Digistick reserves the right to refuse any request received beyond 30 days after the date of service completion or cancellation. Any request made after this period may be considered untimely and invalid.

  4. Internal Review and Investigation: Upon receiving a refund request, Digistick will conduct an internal investigation to verify the facts. Digistick will determine whether Digistick has failed to meet its obligations under the contract and whether the request falls within the narrow exception to this Policy. Only requests that are found to be valid under the terms of this Policy will be considered for refund. Digistick’s decision after the investigation is final.

  5. Refund Calculation and Processing: If a refund is approved, the amount will be calculated by deducting all applicable government taxes, statutory fees, and third-party charges (including payment processing fees) from the total paid by the Client. The net amount, if any, will be refunded. Approved refunds will be issued via the same payment method used by the Client, or by bank transfer at Digistick’s discretion, within a reasonable time after approval (typically within 14 business days). Digistick may also withhold any refundable amount for a brief processing period to ensure compliance with this Policy.

  6. Denial of Requests: Digistick reserves the absolute right to deny any refund request that is incomplete, fraudulent, or not submitted in accordance with the above process. The Client’s failure to follow this procedure or satisfy the terms of this Policy will result in an automatic denial. All determinations by Digistick regarding refunds are final and binding, and Digistick will not reverse or modify its decision once made.

Important: Digistick will only act on properly documented and timely requests as described. Any request sent by means other than email, or lacking the required information, will not be considered. Digistick’s internal investigation must confirm Digistick’s fault before any refund is issued; absent such confirmation, no refund will be provided.

Legal Liability Disclaimer

To the fullest extent permitted by law, Digistick’s liability and the Client’s remedies are strictly limited as follows:

  • No Liability for Client-Related Issues: Digistick shall not be liable for any losses, damages, delays, or expenses arising out of or in connection with any issues caused by the Client or events beyond Digistick’s control. This includes, without limitation, delays due to the Client’s failure to provide information or approvals, any change in project requirements by the Client, the Client’s personal circumstances (such as illness, emergencies, death, or changes of mind), or any force majeure events. Digistick explicitly disclaims any responsibility for costs or damages resulting from client-initiated delays or cancellations.

  • Limitation of Damages: In no event shall Digistick’s total liability to the Client exceed the amount of fees actually paid by the Client for the particular service in question. Digistick will not be responsible for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost business, or loss of data, even if advised of the possibility of such damages. This limitation applies regardless of the cause of action.

  • Waiver of Legal Rights: The Client expressly agrees not to pursue any legal action, suit, or claim against Digistick (or its officers, directors, employees, or agents) with respect to any dispute arising out of or relating to Digistick’s services or this Policy. By engaging Digistick’s services, the Client irrevocably waives the right to initiate litigation or arbitration against Digistick for refund or cancellation issues. This waiver is intended to be as broad as legally permissible. No lawsuit, class action, or other legal proceeding may be brought by the Client against Digistick concerning any matter governed by this Policy, except as required by applicable mandatory law.

  • Entire Agreement and Severability: This Policy, together with any underlying service agreement, sets forth the entire understanding between the Client and Digistick regarding refunds and cancellations. If any provision of this Policy is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

  • Applicable Law: This Policy shall be governed by the laws of the jurisdiction in which Digistick is headquartered, without regard to conflict of law principles. The Client acknowledges that any disputes not waived above shall be resolved exclusively under these laws.

Summary: Digistick’s Refund and Cancellation Policy is designed to protect Digistick’s legitimate business interests. The Client is responsible for understanding and accepting these terms before engaging Digistick’s services. By proceeding with the purchase of any service, the Client confirms that they have read, understood, and agreed to this Policy in full. Any request for exceptions or legal recourse outside of this framework will not be entertained.
